Terms of Use
At a glance
- Flok is a pet-care app. It is not veterinary advice. For emergencies, call a vet.
- You need to be at least 13 to use Flok. If you are under 16 in the EEA or UK, your parent or guardian must agree.
- We offer a free tier and paid subscriptions billed through the App Store.
- You keep ownership of your pet’s data and photos. You give us a limited licence to store and display them so the app can work.
- If you live in the EEA, UK, or Switzerland, Polish law applies and you have full consumer rights. If you live in the United States, disputes go to individual arbitration with carve-outs (§13.3). If you live elsewhere, §13.4 tells you where disputes are heard.
- Flok is not available in Russia or Afghanistan, or anywhere that receiving the service would break sanctions law.
1. What these Terms cover
These Terms of Use (the “Terms”) are an agreement between you and flok sp. z o.o. (“Flok”, “we”, “us”), Polish registered company, ul. Domaniewska 17/19, lok. 133, 02-672 Warszawa. They govern your use of:
- The Flok mobile application (“App”);
- The Flok website at flokpetapp.com; and
- Any related services (together, the “Service”).
By creating an account, downloading the App, or using the Service, you agree to these Terms.
2. Not veterinary advice
Flok gives you a place to record and organise your pet’s care. It does not diagnose, prescribe, or treat. Do not rely on the App for medical decisions. Always consult a licensed veterinarian, especially in an emergency. If your pet is in distress, go to a vet now, not the app.
3. Eligibility and your account
3.1 Age
You must be at least 13 years old to create an account. If you live in the European Economic Area or the United Kingdom and are under 16 (or the lower age set by your country; in Poland, 13), your parent or guardian must give verifiable consent.
3.2 Account
You are responsible for keeping your login credentials confidential. You agree to give us accurate information when you sign up and keep it current. Tell us straight away if you think someone else has accessed your account.
3.3 One account per person
One account per person. You can add multiple pets and share access with household members through the in-app sharing flow. Shared commercial resale of Flok accounts is not allowed.
4. The Service
4.1 What Flok does
Flok lets you store pet records, set routines, log daily check-ins, scan documents (via the Google Gemini API), and find nearby pet services.
4.2 Availability
We work hard to keep the Service up and available, but we do not promise uninterrupted access. Features may be added, changed, or removed. Material removals will be announced at least 30 days in advance where practical.
4.3 Geographic exclusions
Flok is not available in Russia or Afghanistan. Flok is also not available to persons or entities on any applicable sanctions list (including US OFAC SDN, EU restrictive measures, UK OFSI, and UN consolidated list). You represent that you are not on such a list and that you will not use the Service from an excluded country.
5. Subscriptions, free trial, and billing
5.1 Plans
Flok offers a free tier. Premium subscriptions unlock additional features at a monthly or annual price shown in-app.
5.2 Payment
All paid subscriptions are billed through the Apple App Store using the payment method on file in your Apple ID. Apple’s terms and refund policies apply to the transaction.
5.3 Auto-renewal
Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the renewal date through your Apple ID settings. Flok cannot cancel an Apple subscription on your behalf.
5.4 Free trial
If we offer a free trial, it converts to a paid subscription at the end of the trial period unless you cancel at least 24 hours before the end of the trial.
6. Refunds and withdrawal
6.1 Apple App Store refunds
All refund requests are processed by Apple. Use reportaproblem.apple.com.
6.2 EU / EEA / UK withdrawal right
If you live in the EEA or UK, you normally have a 14-day right to withdraw from a distance purchase of digital content. By starting to use a paid feature during this period with your express consent, you acknowledge that you lose the withdrawal right for that feature. You will be asked to confirm this at the point of purchase.
6.3 Statutory rights preserved
Nothing in these Terms limits your statutory consumer rights that cannot be waived, including under Polish law and, if applicable, other EU member-state law, UK law, or US state law.
7. Acceptable use
You agree not to:
- Upload content that is unlawful, harmful, defamatory, or infringing.
- Upload another person’s personal data without their consent.
- Use the Service to give veterinary or medical advice to anyone else.
- Reverse engineer, decompile, or tamper with the App, except as permitted by mandatory law.
- Interfere with the Service or other users’ use of it (scraping, flooding, abusing rate limits).
- Use the Service to build a competing product.
- Circumvent the geographic exclusions in §4.3.
We may suspend or terminate your access for material breach of this section.
8. Your content
8.1 Ownership
You keep ownership of the data, records, and photos you upload (“Your Content”).
8.2 Licence to us
To operate the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify (only for technical purposes such as resizing), display, and transmit Your Content, solely to provide the Service to you and to any people you share it with. The licence ends when you delete the content or close your account, except for backups we are allowed to keep for a reasonable time for security and legal purposes.
8.3 Public content
Reviews or similar content you choose to post publicly are visible to others and may remain online after you close your account. You can ask us to remove a review you posted at any time.
8.4 Removal
We may remove content that breaches these Terms or applicable law. Where possible we will tell you why.
9. Intellectual property
The Flok name, logo, App, website, and all software and design elements belong to Flok or its licensors. These Terms do not transfer any of that to you. You receive a limited, revocable, non-transferable licence to use the Service for its intended purpose.
10. Third-party services
The Service integrates with third-party services (App Store, Gemini API, and others listed in the Privacy Policy). Your use of those services is governed by their own terms. We are not responsible for the acts or omissions of third-party services, except to the extent required by law.
11. Termination
11.1 By you
You can stop using the Service at any time. Delete your account from the in-app settings or by emailing info@flokpetapp.com.
11.2 By us
We may suspend or terminate your account if you materially breach these Terms, if we reasonably believe that continued access creates legal risk for us or our users, or if we stop offering the Service. Where practical we will give you prior notice and a chance to cure.
11.3 Effect of termination
On termination, your right to use the Service ends. Your data is retained and deleted per the Privacy Policy. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, dispute resolution) do.
12. Warranties and liability
12.1 Disclaimer
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
12.2 Consumer protection
Nothing in §12.1 or §12.3 removes your statutory consumer rights under Polish law, other EU member-state law where it applies to you, UK law, or US state law where it applies. For consumers protected by the EU Consumer Rights Directive or equivalent, we provide the service with reasonable skill and care.
12.3 Limitation of liability
To the maximum extent permitted by law, Flok’s total liability to you for any claim arising from or relating to the Service is limited to the amount you paid Flok for the Service in the twelve months immediately before the event giving rise to the claim. If you did not pay Flok anything in that period, this limit is zero.
We are not liable for indirect, incidental, consequential, special, or punitive damages; lost profits or revenue; or loss of data beyond what any consumer-protection law requires us to cover.
Nothing in this section limits liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law.
13. Dispute resolution
13.1 Try to talk first
Before filing a claim, please email info@flokpetapp.com with a description of the issue. We will do our best to resolve it within 30 days.
13.2 EEA, UK, Switzerland
These Terms are governed by Polish law. You can bring proceedings in the Polish courts, or in the courts of your country of residence if local consumer-protection law gives you that right. The EU online dispute-resolution platform is at ec.europa.eu/consumers/odr.
13.3 United States: binding individual arbitration (opt-out available)
Please read this section carefully. It affects your legal rights.
If you reside in the United States, you and Flok agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by JAMS under its streamlined Consumer Arbitration Minimum Standards, in English, in a location reasonably convenient to you or by video, rather than by a court or jury. The Federal Arbitration Act governs the interpretation and enforcement of this clause.
Class-action waiver: claims must be brought in your individual capacity only, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator cannot consolidate claims or preside over a class proceeding.
Carve-outs: either party may bring (a) a claim in small-claims court if it qualifies, (b) a claim for injunctive relief to protect intellectual-property rights, (c) claims that cannot be arbitrated under applicable law (e.g., certain public-injunction claims under California law), and (d) mass arbitrations, for which a separate protocol applies.
Opt-out: you can opt out of this arbitration agreement by emailing info@flokpetapp.com within 30 days of first accepting these Terms with the subject line “Arbitration Opt-Out” and your account email. Opt-out is individual and does not affect any other agreement you have with Flok.
Non-waiver: if any portion of this arbitration clause is found unenforceable, the remainder stays in effect, except that if the class-action waiver is found unenforceable, the entire arbitration clause is void.
13.4 Elsewhere
If you live outside the EEA, UK, Switzerland, or United States, disputes are resolved in the Polish courts and governed by Polish law, except where mandatory local consumer law says otherwise.
14. Changes to these Terms
We may change these Terms. Material changes take effect no sooner than 30 days after we publish them and notify you in-app or by email. Continued use after the effective date means you accept the updated Terms. If you do not accept, stop using the Service and delete your account. Previous versions are available on request at info@flokpetapp.com.
15. Miscellaneous
- Entire agreement: these Terms plus the Privacy Policy are the whole agreement between you and Flok about the Service.
- Severability: if any part is found unenforceable, the rest stays in effect.
- No waiver: if we don’t enforce a right, that doesn’t waive it.
- Assignment: you can’t assign your rights under these Terms. We can, to a successor to our business under §5.4 of the Privacy Policy.
- Language: the English version of these Terms is the governing version. Translations are provided for convenience.
- Apple-specific terms: you acknowledge that these Terms are between you and Flok, not Apple. Apple is not responsible for the App or its content. Apple is, however, a third-party beneficiary of these Terms and may enforce them against you as a user.
